This privacy notice applies to the external job board which is provided by Uniper SE, Holzstraße 6, 40221 Düsseldorf, Germany, via the URL careers.uniper.energy

As the protection of your privacy when using our Jobboard is important to us, we would like to inform you with this privacy notice in accordance with Art. 13 of the General Data Protection Regulation (GDPR) about how our company processes personal data in the context of our external Jobboard and to inform you about your corresponding rights in this regard. 

This privacy notice uses the terminology of the GDPR. The terms used, such as "recipient" or "user", are chosen for the sake of clarity and are to be understood as gender-neutral.

2. Brief overview of the purposes and legal bases of the processing 

We process personal data of users of our Jobboard if this data is technically necessary for the functionality, security and display of our Jobboard or if this data is provided to us by our users. The extent to which the following explanations apply to you depends on how you interact with us in each case.

We process personal data for one or more of the following purposes:

  • for the provision, functionality, security and display of our Jobboard,
  • for the purpose of consent management,
  • for the purpose of location-based area search and geolocalisation required for this,
  • for the establishment of contact and processing of your request,
  • for the purpose of subscribing for, obtaining and cancelling our newsletter,
  • for the map-based localisation display of job offers, and
  • for advertising of and forwarding to our social media presences.

     

Our processing of personal data is based on the following legal bases: 

  • your consent in accordance with Art. 6 (1) (1) (lit. a) GDPR and/or § 25 TDDDG;
  • for the fulfilment of legal obligations pursuant to Art. 6 (1) (1) (lit. c) GDPR; and/or
  • on the basis of a legitimate interest pursuant to Art. 6 (1) (1) (lit. f) GDPR.

3. Specific processing activities: Categories of data processed and scope, purpose and legal bases of processing 

In this section, we inform you about the specific processing operations, the data processed in each case, the scope and purpose of the respective data processing and the relevant legal bases.

3.1. Hosting, storage and content delivery network

3.1.1. Hosting and storage

Our Jobboard is hosted by an external service provider. The personal data collected in the context of the Jobboard is stored on the hoster's servers in Frankfurt, Germany. This may include IP addresses, contact requests, meta and communication data, contact details, names, Jobboard accesses and other data generated via our Jobboard.

The use of the hoster is based on our legitimate interest in a secure, fast and efficient provision of our Jobboard and the secure storage of the data generated via our Jobboard by a professional provider (Art. 6 (1) (1) (lit. f) GDPR). 

In order to ensure that your data is processed and protected in compliance with data protection regulations, we have concluded a data processing agreement with our hoster in accordance with Art. 28 GDPR. In this contract, our hoster guarantees in particular that it will only process personal data if and insofar as this is necessary to fulfil its service obligations.

While the processing is carried out exclusively in Europe, according to the assurance of our processor, there is a data transfer to the United States of America due to the location of our service provider in the United States of America. The data transfer is based on the EU Commission's adequacy decision for the USA (Art. 45 GDPR - Transatlantic Data Privacy Framework, hereinafter ‘TADPF’) and additionally concluded standard contractual clauses in accordance with Art. 46 GDPR.

3.1.2. Content delivery network

We use a so-called Content Delivery Network ("CDN"), i.e. a service that optimises the transmission of content via the Internet. Our service provider only routes the data concerned through its own networks, whereby only temporary (intermediate) storage takes place to optimise the transmission speed. 

The CDN is used in the interest of fast, efficient and resilient provision of our Jobboard services by a professional provider (Art. 6 (1) (1) (lit. f) GDPR).

In order to ensure that your data is processed and protected in compliance with data protection regulations, we have concluded a data processing agreement with our CDN service provider in accordance with Art. 28 GDPR. In this contract, our service provider guarantees in particular that it will only process personal data if and insofar as this is necessary to fulfil its service obligations.

While the processing is carried out exclusively in Europe, according to the assurance of our processor, there is a data transfer to the United States of America due to the location of our service provider in the United States of America. The data transfer is based on the EU Commission's adequacy decision for the USA (Art. 45 GDPR - TADPF) and additionally concluded standard contractual clauses in accordance with Art. 46 GDPR.

3.2. Functionality, Security and Display of our Jobboard

When you visit our Jobboard, it is technically necessary for data to be transmitted to our web server via your Internet browser. The following data is recorded in a server log file during an ongoing connection for communication between your Internet browser and our web server:

  • IP address of the requesting device
  • Visited domain
  • Date and time of the request
  • Website from which an access system reaches our Jobboard (referrer URL)
  • Access status (file transferred, file not found, etc.), error message(s)
  • URL parameters (filter, utm_source)
  • Web browser used and version
  • Operating system used and version
  • Amount of data transferred.

The collection and processing of technically necessary data is carried out for the purpose of providing and securing our Jobboard. The basis for processing is our legitimate interest in the secure, technically error-free and visually appealing provision of our Jobboard, Art. 6 (1) (1) (lit. f) GDPR. 

The above data are also recorded in log files, dependent on the kind of log file concerned stored for 3-30 days and then deleted. The log file data records may be analysed, in order to protect our Jobboard against attacks, to find and rectify errors and to control server capacity utilisation. This is also the basis of our legitimate interest in a confidential, available and integer data processing, Art. 6 (1) (1) (lit. f) GDPR. We reserve the right to process log file data further if there are concrete indications of unlawful use.

Aforementioned data is not merged with other data or data sources.

3.3. Consent request and management

We use the service of an external service provider to request and manage your consent preferences. We process the following personal data as part of the consent request and management process:

  • IP address
  • User Agent
  • Consent ID
  • Consent status
  • Opt-in/opt-out preferences
  • User settings, e.g. language setting
  • Date and time of consent/revocation, if applicable.

The data is collected and processed via the "ppms_privacy_xxx" cookie. On the one hand, the processing is carried out to ensure that processing requiring consent, including the placement and use of optional cookies/technologies, only takes place with your prior consent. This constitutes a legitimate interest within the meaning of Art. 6 (1) (1) (lit. f) GDPR. On the other hand, the storage of your consent takes place in order to comply with legal documentation and verification requirements, Art. 6 (1) (1) (lit. c) in conjunction with 7 (1) GDPR.

You can revoke your consent at any time via our "Cookie settings" function with effect for the future. The legality of any processing that has already taken place on the basis of your consent up to the point of revocation remains unaffected by your revocation. 

In order to ensure data protection-compliant processing and protection of your data, we have concluded a data processing agreement with our consent management service provider within the meaning of Art. 28 GDPR. In this contract, our processor guarantees in particular that it will only process personal data if and insofar as this is necessary to fulfil its service obligations.

According to the assurance of our service provider, the processing takes place within the EU. 

3.4. Geolocalisation for the purpose of location-based searches

If you would like to use a location-based radius search for your job search, you can initiate and perform this using our ‘Search the World’ filter. We will only request your browser to determine your location if you have clicked on the ‘Use my location’ field to give your consent. We will not localise your location without your prior consent.

If you have given your consent the browser-native ge localisation API is used to determine your location. The API transmits the coordinates of your end device to us. We then append the received coordinates as a parameter to the URL so that they can be used as a filter in our database query and, in the case of a search query initiated by you, they are processed together with the IP address of your device and the timestamp of the search query in order to present you with the location-relevant results you want. The coordinates are not processed any further than this.

If you consent to the location being determined in the manner described above, we will process the coordinates of your end device on the basis of your consent, Art. 6 (1) (1) (lit. a) GDPR. You can revoke your consent at any time by resetting the filters on our Jobboard or by revoking your consent in your browser settings with effect for the future. The legality of the processing already carried out on the basis of your consent up to the time of your revocation remains unaffected.

Please note: We have no influence over any processing of personal data by the service provider of the browser you use in this context. Therefore, the service provider of the browser you use is solely responsible for data protection and liability when it comes to processing taking place on their site.

3.5. Contact request

When you contact us (e.g. by email or telephone), we store and process your data to process your enquiry and in the event that follow-up questions arise. The data processed in this context includes at least the contact details you provide (e.g.: in the case of an email enquiry, your email address; in the case of a phone enquiry, your telephone number), as well as any other information you provide when contacting us or in the course of follow-up communication. Your data will not be passed on to third parties without your prior consent. 

If and insofar as you wish to contact us, for example because you send us an email or chat message, call us or write to us via a contact form, the legal basis for the processing is Art. 6 (1) (1) (lit. f) GDPR. We have a legitimate interest in the complete processing of your enquiry. Since you are contacting us, we assume that you have no conflicting interests. If the contact is aimed at the initiation, conclusion or performance of a contract, the legal basis for the processing is Art. 6 (1) (1) (lit. b) GDPR. If you have given us your consent, the legal basis for processing is your consent, Art. 6 (1) (1) (lit. a) GDPR.

Please note: In order to comply with the data minimisation principle in the best possible way, we kindly ask you to limit your information to what is necessary, as far as possible.

3.6. Newsletter on job offers

You can also use our Jobboard to sign up for our newsletter, which provides information on current job offers that might be relevant to you. In this context, we process personal data when you subscribe to our newsletter using our double opt-in procedure, when we send you the requested newsletter and when you unsubscribe from our newsletter.

We require and process your email address for the purpose of new registration for our newsletter. Further data is not collected or is only collected on a voluntary basis. The legal basis for the processing of your personal data in the context of registration is our legitimate interest in carrying out the verification procedure as part of the double opt-in procedure, Art. 6 (1) (f) GDPR. Since you initiate the procedure by registering, we assume that there are no important interests that conflict with our processing.

To verify your email address, you will then receive a registration email, which you can use to confirm your registration for the newsletter by clicking on the confirmation link contained therein. If you confirm your registration via the link, we store your IP address as well as the date and time of your registration. The processing of this data is necessary in order to be able to prove that consent has been given. The legal basis for this processing is our legal obligation to prove your consent, Art. 6 (1) (1) (lit. c) in conjunction with Art. 7 (1) GDPR.

The aforementioned personal data will also be stored by our shipping service provider and used for shipping purposes or rather to send you the requested newsletter. The legal basis for the processing of your personal data is your consent in accordance with Art. 6 (1) (1) (lit. a) GDPR. You can revoke your consent at any time with effect for the future via the link provided in the newsletter (‘Unsubscribe/Abmelden’).

If you cancel your subscription to our newsletter using the link provided in the newsletter (‘Unsubscribe/Abmelden’), your personal data will be deleted from the distribution list immediately. Data that we have stored for other purposes remains unaffected.

3.7. Map service 

Our Jobboard also integrates an external map service to provide you with an efficient, clear and easy-to-use overview of the current job offers at Uniper locations. It also allows you to display the results of your search on a map in the case of a location-based radius search (see chapter 3.5. of this data protection declaration).

When using the map service, the following personal data is processed when the map tiles are loaded:

  • IP address of your device
  • Device information (device type, browser type and version, operating system and version)
  • Referring website (referrer URL)
  • Date and time of the page view
  • Page viewed

In the case of a proximity search, the transmitted coordinates of your end device are also processed in order to locate the search results on the map and to offer you location-relevant search results.

The map service is used in the interest of an efficient, clear and easy-to-use presentation of relevant job offers (Art. 6 (1) (1) (lit. f) GDPR). Since you activate the map service function, we assume that there are no important interests opposing the processing.

Any additional processing of the coordinates of your end device that may be necessary to locate and display relevant results will only be carried out on the basis of your prior consent to location determination and processing (Art. 6 (1) (1) (lit. a) GDPR). You can revoke your consent at any time by resetting the filters on our Jobboard or by revoking your consent in your browser settings with effect for the future. The legality of the processing already carried out on the basis of your consent up to the time of your revocation remains unaffected.

In order to ensure that your data is processed and protected in compliance with data protection regulations, we have concluded a data processing agreement with our map service provider in accordance with Art. 28 GDPR. In this contract, our processor guarantees in particular that it will only process personal data if and insofar as this is necessary to fulfil its service obligations.

Processed data is stored in the Netherlands and the United Kingdom and processed within the EU. The data transfer to the United Kingdom is based on the European Commission's current adequacy decision for the United Kingdom (Art. 45 GDPR), according to which an adequate level of protection is guaranteed.

3.8. Promotion of our social media presence via external graphic link

We also advertise our presence on the following social networks on our website:

  • Facebook – Social network owned by Meta Platforms Inc. (1601 Willow Road, Menlo Park, CA 94025, USA “Facebook”), which is operated in Europe by Meta Platforms Ireland Limited (4 Grand Canal Square, Dublin 2, Ireland).
  • Instagram – Social network owned by Meta Platforms Inc. (1601 Willow Road, Menlo Park, CA 94025, USA “Facebook”), which is operated in Europe by Meta Platforms Ireland Limited (4 Grand Canal Square, Dublin 2, Ireland).
  • LinkedIn – Social network owned by LinkedIn Corporation Inc. (1000 West Maude Avenue, Sunnyvale, CA 94085, USA; “LinkedIn”), which is operated in Europe by LinkedIn Ireland Unlimited Company (Wilton Place, Dublin 2, Ireland).
  • Youtube – Social video platform of YouTube LLC (901 Cherry Avenue, San Bruno, CA 94066, USA; “YouTube”), which is a subsidiary of Google LLC (1600 Amphitheatre Parkway Mountain View, CA 94043, USA; “Google”) and is operated in Europe by Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland).
  • X / Twitter – Social network of X Corp (1355 Market Street, Suite 900, San Francisco, CA 94103, USA “X”), which is operated in Europe by X Internet Unlimited Company (One Cumberland Place, Fenian Street, Dublin 2, D02 AX07, Ireland).

The integration is done via a linked graphic of the network. The use of these links prevents the automatic establishment of a connection to the respective social network server when a website with a social media link is accessed. Only by clicking on the corresponding link is the user redirected to the social network service.

After the user is redirected, information about the user is collected by the social network. It cannot be ruled out that the data collected in this way may be processed in the USA. The controller has no influence whatsoever on the processing that takes place after redirection, which is the responsibility of the respective social network.

The data processed in this context is primarily personal data such as IP address, date, time, and page visited. If the user is also logged into their user account on the respective network during this time, the network operator may be able to assign the information collected about the user's specific visit to the user's personal account. If the user interacts via a “share” button of the respective network, this information may be stored in the user's personal user account and published if necessary. If the user wants to prevent the collected information from being directly assigned to their user account, they must log out of their account before clicking on the graphic link provided on our website. It is also possible to configure the respective user account accordingly.

The legal basis for the integration of the links on our website is our legitimate interest in promoting and increasing the visibility of our social media presence, Art. 6 (1) (1) (f) GDPR. There is no apparent conflicting interest on your part..

Please note: Clicking on the respective link will redirect you to the website of the social network in question. As a result of this redirection, your personal data may be transferred to servers in the USA, despite the fact that some of the network's subsidiaries are based in Europe. The above-mentioned network operators are all certified under the TADPF.

3.9. Processing in the application and recruitment process

If you apply for an advertised position via our Jobboard, we will also process personal data about you as part of the subsequent application and recruitment process With regard to the processing of this data, reference is made at this point to the ‘Privacy notice for applicants’, which regulates in detail the processing carried out in the context of and for the purpose of the application and recruitment procedure and which is made available to you separately in the context of the application form.

4. Recipients

We pass on your personal data within our company and with regard to affiliated companies and processors only to those companies, departments and persons who require this data for further processing. The relevant group of recipients/persons is defined in an authorisation/permission rights concept and limited to what is absolutely necessary.

Otherwise, data will only be passed on to recipients outside the company if this is permitted or required by law, if we have your consent or if we are authorised or obliged to provide information. Under these conditions, recipients of personal data may be, for example: 

  • Public authorities (e.g. law enforcement authorities, criminal, civil and administrative courts, tax authorities, etc.), insofar as the disclosure is legally permissible and required (Art. 6 (1) (1) (lit. f) GDPR) or necessary to fulfil a legal obligation to which we are subject (Art. 6 (1) (1) (lit. c) GDPR).
  • Professional secrecy holders (e.g. lawyers), insofar as this is necessary for the proper conduct of business, including the enforcement of or defence against legal claims (Art. 6 (1) (1) (lit. f) GDPR).
  • Recipients for whom you have given us your consent to transfer the data.

5. International data transfer

As explained in detail in Section 3 of this privacy notice, the data processing carried out in the context of the Jobboard takes place in the European Union and in third countries with an adequacy decision of the European Commission (Art. 45 GDPR), so that an adequate level of protection is ensured.

For the purpose of business continuity, we have also concluded standard contractual clauses in accordance with Art. 46 GDPR with service providers with whom a third-country transfer is possible or takes place, in accordance with our current business practice, in order to ensure an adequate level of protection for your data even in the event that a currently existing adequacy decision is no longer in place.

6. Retention & Deletion

We only store your personal data for as long as is necessary to fulfil the respective processing purpose. We store your data (i) if you have consented to the processing, at most until you revoke your consent; (ii) if we need the data in the context of the initiation or performance of a contract, at most as long as the contractual relationship with you exists; (iii) if we use the data on the basis of a legitimate interest, at most as long as your interest in deletion or anonymisation of the data does not prevail.

Data may also be stored if this has been provided for by the European or national legislator in regulations, laws or other provisions to which the controller is subject (Art. 6 (1) (1) (lit. c) GDPR) or if this is necessary to secure, assert or enforce legal claims or to defend against claims (Art. 6 (1) (1) (lit. f) GDPR). In order not to violate legal regulations or lose the possibility of enforcing a claim or defending ourselves against such a claim, we reserve the right to delete the data only after the expiry of the last expiring limitation or retention period that legitimises the data storage. 

7. Your data subject rights

When your personal data is processed, the GDPR grants you the following rights as a data subject. You can exercise the rights described in sections 7.1.-7.7. against us at any time by simply sending an email to dataprotection@uniper.energy. The right to lodge a complaint described in section 7.8. must be exercised with the competent supervisory authority.

Please note: If you exercise your data subject rights, the personal data processed by us for the purpose of fulfilling your rights will be stored separately and restrictedly for a period of three years from the end of the calendar year in which your request was finally processed, for documentation and verification purposes. This is done on the basis of our legitimate interest in being able to provide evidence of the fulfilment of your requests and, if necessary, to defend ourselves on the basis of evidence (Art. 6 (1) (1) (lit. f) GDPR).

7.1. Right of access (Art. 15 GDPR)

As a data subject, you have the right under Art. 15 GDPR to obtain confirmation as to whether or not personal data concerning you is being processed, and, where that is the case, access to the personal data and the information specified in Art. 15 GDPR. You may also request a copy of the personal data that we hold about you. For each additional copy, we may charge a reasonable fee to cover administrative costs.

7.2. Right to rectification (Art. 16 GDPR)

As a data subject, you have the right to request the rectification or completion of incorrect or incomplete personal data concerning you.

7.3. Right to erasure (Art. 17 GDPR)

You have the right to demand the immediate erasure of personal data concerning you, provided that the conditions listed in Art. 17 GDPR are met. In these cases, your data will be erased or anonymised immediately, unless an exception or legal provision legitimises further processing.

7.4. Right to restriction of processing (Art. 18 GDPR)

You have the right to request the restriction of processing if one of the conditions listed in Art. 18 GDPR is met, e.g. if you dispute the accuracy of the processed data or have objected to the processing. If you exercise this right, the restriction of processing shall apply at least for the duration of the examination by the controller, so that during this period - apart from being stored - the data concerned will only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or of a Member State.

7.5. Right to data portability (Art. 20 GDPR)

In certain cases, which are listed in detail in Art. 20 GDPR, you as the data subject have the right to receive the personal data processed in a structured, commonly used and machine-readable format or to request the transmission of this data to a third party. If you request the direct transfer of the data to another controller, this will only take place if it is technically feasible.

7.6. Right to object pursuant to Art. 21 GDPR

You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on lit. (e) or (f) of Article 6 (1) (1) GDPR, including profiling based on those provisions. If you exercise your right, we will no longer process the personal data concerned unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims (objection pursuant to Art. 21 (1) GDPR).

If your personal data are processed for the purpose of direct marketing, you have the right to object at any time to the processing of personal data concerning you for the purpose of such marketing; this also applies to profiling insofar as it is associated with such direct marketing. If you object, your personal data will no longer be used for the purpose of direct marketing (objection pursuant to Art. 21 (2) GDPR).

To exercise your right to object, it is sufficient to send us an informal message, e.g. by e-mail to the above e-mail address. However, for the purpose of targeted processing, we kindly ask you to (1) state your intention to object to processing and (2) name the respective processing to which you wish to object.

8.7. Right to revocation of consent

You also have the right to withdraw your consent at any time with effect for the future. To do this, you can change the respective consent status via the footer function "Cookie settings" provided by usThe lawfulness of the processing carried out on the basis of your consent until revocation remains unaffected by your withdrawal of consent.

8.8. Right to lodge a complaint with a supervisory authority

Pursuant to Art. 77 GDPR, you also have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you infringes the GDPR or other data protection provisions. This right to lodge a complaint is without prejudice to any other administrative or judicial remedy.

8. Necessity of provision of personal data

You are neither legally nor contractually obliged to provide your personal data. However, the provision of personal data may result from (pre-)contractual requirements or be required for purely technical reasons. 

With regard to our Jobboard, it generally applies that the personal data required for use is labelled with a “*” or is requested and processed within the scope of technical necessity. If this data is not provided, this may mean that certain functions of our Jobboard are not available or that our Jobboard cannot be used in its entirety. 

9. Automated decision-making

We do not use any mechanisms for automated decision-making - including profiling - that have a legal effect on you as the data subject or significantly affect you in a similar way.

10. Data security

We make every effort to ensure the security of your data within the framework of the applicable data protection laws and technical possibilities. To secure your data, we maintain technical and organisational security measures in accordance with Art. 32 GDPR, which we constantly adapt to the state of the art. 

If we also utilise the services of third parties for the processing of your data, they will be selected carefully and in compliance with the statutory provisions. 

11. Cookies and similar technologies

Our job board uses cookies and similar technologies. 

Similar technologies are technical tools that enable, for example, the identification of visitors and users or the evaluation of the use of our Jobboard without being cookies, such as tracking pixels or LocalStorage. 

Cookies are text files that are stored in the Internet browser or by the Internet browser on the user's system. When a user accesses our Jobboard, a cookie can be stored on the user's operating system or, for example, a tracking pixel can be triggered. Cookies contain a characteristic string of characters that can, for example, enable the browser to be uniquely identified when the Jobboard is called up again and are stored on your end device either temporarily for the duration of a session (session cookies), for a certain period of time (temporary cookies) or permanently (permanent cookies). Session cookies are automatically deleted at the end of your visit. Temporary cookies are deleted after a certain period of time. Permanent cookies remain stored on your end device until you delete them yourself or they are automatically deleted by your web browser. 

Cookies and similar technologies from third-party companies may also be stored on your end device or triggered when you visit our Jobboard (third-party cookies). These enable us or you to use certain services of the third-party company (e.g. cookies to store information about the source from which a user came to our Jobboard).

Technically necessary cookies and technologies are those without which our Jobboard cannot function or be used. This category only contains cookies and technologies that guarantee basic functions, the presentation and security features of the Jobboard or the request for consent for optional cookies and technologies (cookie banner). Technically necessary cookies and technologies can be set without the user's consent.

Non-essential or optional cookies and technologies are all cookies and technologies that are not required for the pure functionality, display and security of the Jobboard. This includes functional cookies that enable, for example, a customer chat, and in particular cookies and technologies that are used to collect and process the user's personal data, such as statistics, performance, marketing and analysis cookies. Non-essential cookies and technologies require your prior, informed consent

If we use optional cookies and similar technologies, we will ask for your express consent via our cookie banner when you visit our Jobboard. If you consent to the use of cookies and technologies, we and any third parties will process the data collected on the basis of your consent, Art. 6 (1) (1) (lit. a) GDPR and § 25 TDDDG .
